Session Booking Terms & Release

When you book a session through The Workaround Collective (“WC”) — a mentor call, a creator session, or a call with another member — these Session Booking Terms & Release apply in addition to WC’s Terms of Use, Privacy Policy, and Community Guidelines, including the governing-law and dispute-resolution provisions therein. Please read them before you book. You agree to them each time you book a session. WC may update these Terms at any time; the version in effect at the time of booking applies.

1. WC is a connector, not the provider

WC helps you find and schedule sessions, and may subsidize part of the booking fee, solely as a technology platform and marketplace intermediary. The session itself is provided by an independent mentor, creator, or member — not by WC. Subsidizing a fee is financial support only; it is not an endorsement, employment, agency, supervision, or a guarantee of the provider or the session. WC does not employ, direct, or control providers and does not verify their qualifications, credentials, licenses, or the safety, accuracy, or quality of what they offer, beyond our basic community rules.

2. Sessions are between you and the provider

Any session is a direct interaction between you and the provider. Choosing to book and attend one is at your own discretion and risk. WC is not a party to that interaction and is not responsible for what happens during it or as a result of it.

3. Not professional advice

Sessions are peer guidance, coaching, wellness, or creative content — not professional legal, financial, medical, psychological, therapeutic, or licensed career-counseling advice — and create no professional, fiduciary, or provider-client relationship. No outcome, including employment, is guaranteed, and you are responsible for your own decisions.

4. Wellness sessions — movement & nutrition

Some creators offer wellness sessions, which may involve physical activity (for example yoga, movement, fitness, stretching, meditation, or breathwork) and/or nutrition and healthy-eating guidance. These carry inherent risks — physical activity can cause injury, and dietary guidance can affect people differently depending on their health. By booking a wellness session you acknowledge and agree that:

  • You are participating voluntarily and are responsible for knowing your own physical condition, dietary needs, and limits.
  • Wellness content is general information — not medical, nutritional, or dietetic advice — and creates no provider-patient or dietitian-client relationship.
  • You will consult a physician — and, for nutrition, a physician or registered dietitian — before beginning any new exercise program or diet, and you are medically able to participate.
  • You will disclose to the creator any relevant health conditions, injuries, allergies, or dietary restrictions, and you will stop immediately and seek care if you feel pain, dizziness, discomfort, or an adverse reaction.
  • You assume all risk of injury or harm arising from the session.
  • The creator — not WC — bears sole responsibility for the content, safety, and conduct of the session; WC has no duty to supervise any session. A creator may require you to sign their own participant waiver before the session; that agreement is between you and the creator.

5. Assumption of risk & release

To the fullest extent permitted by law, you voluntarily assume all risks associated with booking and attending sessions, and you release, waive, and hold harmless WC and its directors, officers, volunteers, and staff from any and all claims, demands, damages, or liabilities — including for personal injury — arising out of or relating to any session or provider, whether or not caused by negligence (but not gross negligence or willful misconduct of WC).

6. No warranties

Sessions and the platform are provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of content.

7. Limitation of liability

To the fullest extent permitted by law, WC is not liable for any indirect, incidental, special, or consequential damages, or for the acts, omissions, advice, conduct, or content of any provider. WC’s total aggregate liability to you for all claims arising under or relating to these Terms or any session shall not exceed the amounts you paid directly to WC (excluding amounts paid to providers) in the twelve (12) months preceding the claim. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless WC and its directors, officers, volunteers, staff, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or relating to your participation in, conduct during, or breach of these Terms in connection with any session.

9. Payment, tokens, cancellations & refunds

Where a creator charges for a session, fees may be paid with tokens (closed-loop reward points — not cash, not redeemable for cash, and subject to WC’s token program terms, which WC may modify or discontinue at any time) or by card through our payment processor. WC may, at its discretion, subsidize part of a booking fee. When a session is refunded, tokens are returned to your balance and any card payment is refunded through the processor; any WC subsidy is returned to WC.

  • If the creator cancels or doesn’t show, you receive a full refund.
  • If you cancel at least 24 hours before the session, you receive a full refund.
  • If you cancel less than 24 hours before, or don’t show, no refund is due — the provider’s reserved time is respected. WC may, in its sole discretion, issue a courtesy refund on a case-by-case basis. Repeated late cancellations or no-shows may limit your access to booking.
  • Rescheduling is encouraged over cancelling — use the reschedule option where available.

10. Not a crisis or therapy service

Sessions are wellbeing, coaching, educational, or creative in nature. They are not therapy, counseling, psychotherapy, or the diagnosis or treatment of any medical or mental-health condition, and the Collective is not a crisis, emergency, or mental-health service. If you or someone else may be in danger or crisis, contact your local emergency number; in the US, you can call or text 988 (Suicide & Crisis Lifeline), available 24/7.

11. Reporting & safety

If anything during a session violates our Community Guidelines or the law, please report it to WC promptly at info@theworkaroundcollective.com. WC may, but is not obligated to, investigate, and may suspend or remove a provider at its sole discretion. WC shall not be liable for any action taken or not taken in response to a report.

The disclaimer, assumption-of-risk, release, limitation-of-liability, indemnity, and payment provisions survive completion, cancellation, or termination of any session, your account, or these Terms.
